The fall semester is in full swing, classrooms are bustling, and students are eager to learn.  But as colleges and universities welcome back their communities, it’s crucial they also ensure their compliance with the ever-evolving landscape of federal civil rights regulations. This three-part series will delve into critical areas of federal guidance that every institution must be aware of.

We begin with Title IX, the cornerstone of gender equity in education.  While many associate Title IX with athletics, its reach extends far beyond. It prohibits discrimination based on sex in all education programs and activities, including admissions, recruitment, financial aid, housing, and academic opportunities.

Recent developments in Title IX guidance demand close attention. The Biden administration has clarified that Title IX encompasses protection against discrimination based on sexual orientation and gender identity, emphasizing a welcoming and inclusive environment for all students.  This includes addressing issues related to transgender students’ access to facilities and participation in activities aligned with their gender identity.

Moreover, the recent*”Dear Colleague Letter” issued by the Department of Education provides comprehensive guidance on investigating Title IX complaints, focusing on fair and impartial investigations, timely resolution processes, and victim-centered support.  Colleges and universities must ensure their internal processes are aligned with these guidelines to uphold a safe and equitable environment for all.
