Education Department Finds Michigan, CUNY Failed to Follow Title VI” in Inside Higher Ed

In a recent development, the US Department of Education has found that the University of Michigan and the City University of New York (CUNY) failed to comply with Title VI of the Civil Rights Act of 1964. This federal law prohibits discrimination on the basis of race, color, and national origin in programs and activities receiving federal financial assistance.

According to Brigid Harrington, an expert in higher education law, “The Education Department’s findings are a significant reminder that institutions of higher education have a legal obligation to ensure that their policies and practices do not discriminate against students, faculty, or staff based on their race, national origin, or other protected characteristics.”

The investigation, which was launched in response to complaints filed by students and faculty members, revealed that both universities had failed to take adequate steps to prevent discrimination and harassment on their campuses. Specifically, the Department of Education found that Michigan and CUNY had not properly addressed incidents of racial harassment and discrimination, and had not provided adequate support to students who had experienced such incidents.

The consequences of non-compliance with Title VI can be severe, including the loss of federal funding. In this case, the Education Department has required both universities to take corrective action to come into compliance with the law. This includes implementing new policies and procedures to prevent discrimination and harassment, as well as providing training to students, faculty, and staff on their rights and responsibilities under Title VI.

As Harrington noted, “The Education Department’s findings serve as a wake-up call to institutions of higher education across the country. It is imperative that universities take proactive steps to prevent discrimination and harassment, and to ensure that all members of their communities feel safe and supported.”
